By using the Platform, you agree to these Terms.

Eligibility
You may use the Platform as an individual or on behalf of a business. If you are using the Platform on behalf of a company, you confirm you have authority to bind that entity.

Inbox Up provides tools and services related to email deliverability, including but not limited to:
Domain and DNS analysis
ESP and account integrations
Email performance insights
AI-generated recommendations ("Inbox Up Feedback")
Manual support and issue resolution ("Fix Now" requests)
We may update, modify, or discontinue features at any time.

Account & Access Responsibility
You are responsible for:
Maintaining the security of your accounts and integrations
Ensuring credentials and API connections are secure
All activity that occurs under your account
Inbox Up is not responsible for unauthorized access resulting from your failure to secure your systems.

Authorization to Access and Modify Accounts
By using the Platform and requesting support, you expressly authorize Inbox Up to:
Access connected systems (e.g., domain registrars, ESPs, analytics tools)
Modify DNS records, sending configurations, and related settings
Perform technical changes necessary to resolve deliverability issues
Connect your infrastructure to third-party services (e.g., warmup tools, inbox testing, blacklist remediation)
All actions are performed in good faith to improve your email deliverability.

No Guarantees & Performance Disclaimer
Inbox Up does not guarantee:
Inbox placement
Deliverability improvements
Open rates, click rates, or campaign performance
Resolution timelines (including any references to “15-minute fixes”)
Some issues may be resolved quickly, but many require time, testing, or external dependencies.

Limitation of Liability
To the fullest extent permitted by law, Inbox Up is not liable for:
Loss of revenue, profits, or business opportunities
Email performance issues (including spam placement or low engagement)
Blacklisting or delisting outcomes
Domain or IP reputation damage
Account suspensions or bans by providers such as SendGrid, Klaviyo, or others
Any indirect, incidental, or consequential damages
All services are provided “as is” and at your own risk.

AI & Recommendations Disclaimer
“Inbox Up Feedback” includes AI-generated insights and recommendations.
These are:
Informational only
Not guaranteed to be accurate or complete
Not a substitute for professional judgment
You are responsible for how you act on these recommendations.

Acceptable Use
You agree NOT to use the Platform to:
Send spam or unsolicited bulk email in violation of applicable laws
Engage in fraud, phishing, or deceptive practices
Violate regulations such as CAN-SPAM, CASL, or GDPR
Upload or process illegal or harmful content
We reserve the right to suspend or terminate accounts engaging in such behavior immediately.

Subscription & Billing
The Platform operates on a subscription basis (monthly, with future yearly options)
Subscriptions automatically renew unless canceled
A 7-day free trial is provided with no credit card required
After the trial, access is restricted until payment is added
No Refunds
All payments are final. Inbox Up does not offer refunds, except where required by law.

Custom Services
Certain requests may fall outside standard scope and may be quoted separately. These services are governed by additional agreements if applicable.

Suspension & Termination
We may suspend or terminate your account at any time, without notice, if:
You violate these Terms
You misuse the Platform
Your activity creates risk for Inbox Up or others
You may stop using the Platform at any time.

Third-Party Services
The Platform integrates with third-party providers including:
MXToolbox
GlockApps
Warmy
Google Postmaster Tools
We are not responsible for the performance, accuracy, or actions of these third-party services.

Changes to Terms
We may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.

Governing Law
These Terms are governed by the laws of Ontario, Canada.
